Exclusions for Death Benefits Not Caused by Accident
No Death benefit will be payable if the occurrence of Life insured event results directly or indirectly from any of the following:
a. The Life Insured committed suicide or attempted suicide within two years from the Policy Issue Date or the effective date of its last reinstatement, whichever is later, whether the Life Insured is sane or insane, or
b. The Life Insured’s death results directly or indirectly from a committed criminal offense or an attempted commitment of a criminal offense. Beneficiaries not involved in the aforementioned criminal activity will remain eligible to receive their benefits.
c. The Life Insured dies as a consequence of the Acquired Immune Deficiency Syndrome (AIDS) or any complications associated with infection by the Human Immunodeficiency Virus(HIV).
If the Life Insured’s death results directly or indirectly from exclusions b and c, the Company will only refund the total actual premiums paid, without interest, less any loan indebtedness and outstanding premiums with accrued interest, and this Policy is terminated.
Exclusions for Death Benefits Caused by Accident
No Death Benefit Caused by Accident will be payable under this Provision, if the occurrence of the Life Insured event results directly or indirectly from any of the following:
a. The Life Insured committed suicide or attempted suicide, whether the Life Insured is sane or insane
b. The Life Insured’s death results directly or indirectly from a committed criminal offense, or an attempted commitment of a criminal offense. Beneficiaries not involved in the aforementioned criminal activity will remain eligible to receive their benefits.
c. Any unprescribed drug, alcoholic substance, poison, gas or fumes, voluntarily taken, administered, absorbed or inhaled
d. Any loss sustained by the Life Insured while resisting arrest by a law enforcement officer or violation of alcohol intake and/or speed limits as prescribed by the applicable traffic law at the time of accident
e. Bodily or mental infirmity or illness or disease of any kind or any infection, other than infections occurring simultaneously with and in consequence of an accidental wound
f. Travelling or flight in any vehicle or device for aerial navigation, except as a passenger on an aircraft operated by a regular airline
g. Engaging in or taking part in driving or riding in any kind of race, underwater activities or other hazardous pursuit such as mountaineering or potholing or parachuting or bungee jumping
h. War or any act incidental to war, or service in the armed forces of any country at war or in a civilian force auxiliary thereto. “War” means any war whether declared or not, or any conflict between the armed forces of countries, international organizations or combination thereof. “The armed forces of any country at war” means the military, naval and air forces and will be deemed to include the armed forces of any international organization engaged in war
i. Riot, insurrection, civil commotion, strikes, attacks by bandits or terrorist activities, whether or not the Life Insured was actually participating therein
Exclusions for Major Critical Illness Child Benefits
No Benefit will be payable under this Provision if any claim arising directly / indirectly from any one of the following occurrences:
a. Pre-existing conditions, which existed before the Policy Date or Date of Reinstatement or effective date of Child Protection Benefit, whichever is later. Pre-existing conditions shall mean illnesses that the Policy Owner/Life Insured has reasonable knowledge of, unless the conditions are declared to the Company and accepted by the Company.
A Policy Owner/Life Insured may be considered to have reasonable knowledge of a pre-existing condition where the condition is one for which:
(i) The Life Insured had received or is receiving treatment;
(ii) Medical advice, diagnosis, care or treatment has been recommended;
(iii) Clear and distinct symptoms are or were evident;
(iv) Its existence would have been apparent to a reasonable person in the circumstances.
b. All Critical Illness presenting or diagnosed within the Waiting Period
c. Congenital diseases or birth defects; or
d. Disease/s resulting from Acquired Immune Deficiency Syndrome (AIDS), AIDS-related complex or infection by Human Immune Deficiency Virus (HIV) (except in cases of HIV due to blood transfusion / Occupationally acquired AIDS)
e. Attempted suicide and Self-inflicted injuries while sane or insane;
f. The Life Insured being under the influence of alcohol or the taking of any drug, except under the direction of a registered medical practitioner;
g. War or any act incidental to war, whether declared or not, riot, insurrection, civil commotion, strikes, attacks by bandits or terrorist activities, whether or not the Life Insured was actually participating therein
h. The Life Insured’s death results directly or indirectly from a committed criminal offense, or an attempted commitment of a criminal offense. Beneficiaries not involved in the aforementioned criminal activity will remain eligible to receive their benefits.
