Subject of insurance

Manulife សុខសប្បាយ (សុខសុវត្ថិភាព 5.0 or 10.0) is a life insurance product which provides road accident coverage in case the life insured dies or suffers from total permanent disability or suffers from dismemberment due to accident.

These are described under place of payment on the Insurance Certificate.

The premium is paid on the annual basis. However, company will provide the option of semi-annual, quarterly, monthly payment in special based on company’s discretion.

3.    Insurance Benefits

If សុខសុវត្ថិភាព benefit is selected, the benefits below will be payable in the event of a road accident involving the life insured. Road accident definition in section 1 must be met to be able to claim

·        Accidental Death or Total Permanent Disability Benefit Caused By Road Accident

 

Subject to this Policy’s provisions, the Company shall pay the Death or Total Permanent Disability Benefit in the event of the Life Insured’s death or total permanent disability due to road accident, whichever happens first, upon receipt of acceptable proof and approval by the Company that the Life Insured’s death or total permanent disability meets the definition of Death or Total Permanent Disability Caused by Accident described below. The Death Benefit proceed will be paid to the beneficiary while the Total Permanent Disability Benefit proceed will be paid to the Life Insured. If there is an endorsement to exclude the Death Benefit or Total Permanent Disability Benefit Caused by Road Accident under this Policy, such benefit shall not be paid.

 

The proceeds from the Accidental Death Benefit or Accidental Total Permanent Disability Benefit shall be: 

·       The amount specified on the Insurance Certificate or as subsequently endorsed on the Policy, less 

·       Any outstanding premiums with accrued interest, less

·       Any Accidental Dismemberment benefit payment (if any)

Confirmation of Total Disability must be made by our appointed registered medical practitioner/physician/doctor. The opinion of this registered medical practitioner/ physician/ doctor will be binding on the Life Insured and the Company. For physical loss of limbs, this confirmation can be made at any time.

·       Accidental dismemberment due to road accident

Subject to this Policy’s provisions, Manulife shall pay the Accidental Dismemberment Benefit in the event of the Life Insured’saccidental dismemberment due to road accident upon receipt of acceptable proof and approval by Manulife that the Life Insured’saccidental dismemberment meets the definition of Accidental Dismemberment due to road accident described below. The Accidental Dismemberment Benefit proceed will be paid to the Life Insured. 

The proceeds from the Accidental Dismemberment Benefit shall be a percentage of the amount specified on the Policy Summary following the Table of Benefits below, or as subsequently endorsed on the Policy.

 

The Dismemberment resulted directly, and independently of all other causes, from bodily injury effected solely through external, violent, and accidental means, and such Dismemberment occurred immediately from such injury and before the termination of this Provision.

Accidental dismemberment benefit caused by road accident for each dismemberment will be paid maximum 2 times from different event.

Loss of use of one limb

Loss of all toes – all on one foot

50% of Face Amount

Loss of four fingers and thumb of either hand

"Loss of use of limb" means total, continuous and permanent functional disablement of a limb, which has lasted for at least 180 days. This includes the physical loss of a limb; for arm, at the upper part of the wrist or for leg, at the upper part of the ankle. 

"Loss of sight" means vision that even when tested with the use of visual aids, is measured at 3/60 or worse in an eye using a Snellen eye chart or equivalent test. 

“Loss of hearing” is defined as a definite diagnosis of the total and irreversible loss of hearing in both ears, with an auditory threshold of 90 decibels or greater within the speech threshold of 500 to 3,000 hertz. 

“Loss of speech” is defined as a definite diagnosis of the total and irreversible loss of the ability to speak as the result of physical injury or disease, for a period of at least 180 days. 

"Loss of thumb" means the amputation of all phalanges of the thumb. 

"Loss of toe" means the amputation of all phalanges of the toe. 

In case of multiple injuries from one accident, only the loss carrying the highest indemnity will be payable.  Manulife’s liability on all death, total disability and dismemberment claims in this Policy will be limited to 100% of the Death Benefit specified in the Insurance Certificate.

 

4.    Exclusion

No Benefit will be payable under this Provision, if the occurrence of the insured event results directly or indirectly, in whole or in part, from any of the following:

a)     Suicide or attempted suicide, whether the Life Insured is sane or insane; or

b)    Willful exposure to danger or attempted self-destruction or self-inflicted injuries, whether the Life Insured is sane or insane; or

c)     Assault or murder; or 

d)    A committed criminal offense, or an attempted commitment of a criminal offense by the Policyowner, Life Insured, or Beneficiaries (please refer to Section 8. Beneficiary); or

e)     Any unprescribed drug, alcoholic substance, poison, gas or fumes, voluntarily taken, administered, absorbed or inhaled; or

f)      War or any act of war, whether declared or not, riot, insurrection, civil commotion, strikes terrorist activities, whether or not the Life Insured was participating therein; or

g)    Any loss sustained by the Life Insured while resisting arrest by a law enforcement officer or violation of alcohol intake and/or speed limits as prescribed by the applicable traffic law at the time of accident; or 

h)     Bodily or mental infirmity or illness or disease of any kind or any infection, other than infections occurring simultaneously with and in consequence of an accidental wound; or

i)      Travelling or flight in any vehicle or device for aerial navigation, except as a passenger on an aircraft operated by a regular airline; or

j)      Engaging in or taking part in driving or riding in any kind of race, underwater activities, or other hazardous pursuit such as mountaineering or potholing or parachuting or bungee jumping.

k)     Exclusion – Hazardous sports and high-risk Occupations for សុខសុវត្ថិភាព benefit Courier/Messenger/Deliveryman using motorcycle (two wheels)

l)      When the insured have 2 or more occupations, where either one or more belong to the non-covered occupation list, and the incident happened while performing his duty under a non-covered occupation.

m)   Pre-existing Conditions which originated before the later of the Policy Year Date. A “Pre-existing Condition" is a disability which was observed checked, diagnosed, or treated, or occurred prior to a certain date.

6.    Dispute Mediation

•Complaint Procedures

Any complaint received will be resolved or provided clarification to the complainant within five (5) working days to determine the root cause and the appropriate course of action in accordance with regulatory requirements and the Company’s standard operating procedures.

•Dispute Resolutions

For any dispute arising in relation to the conduct of insurance business, the disputing parties may bring the case to the Insurance Regulator of Cambodia for mediation before filing a lawsuit to arbitration or a competent court, except a criminal case

 

7.    Incontestability

8.    Termination

The policyowner has right to terminate this policy at any time during coverage period of the policy by sending a written request to the company adhere to the original policy contract or insurance certificate. After the company receives a request to terminate the policy, the policy contract will be terminated.
