Dispute resolution procedure

All disputes related to Member's Insurance Policy shall be settled between Manulife and the Member of the Insurance Policy. Both parties shall submit the dispute to the Insurance Regulator of Cambodia for mediation before filing a complaint to the court or arbitration in the Kingdom of Cambodia, except in criminal cases.

Important note

  • Eligible Member for Insurance must be 1-year Fixed Deposit Customer.
  • Insurance Face Amount is equal to 100% of Member’s 1-year fixed deposit amount (rounded to the nearest one). Face amount starts at $1,000 or KHR 4,000,000 and capped at $50,000 or KHR 200,000,000.
  • Only one coverage is given in the event of multiple 1-year Fixed Deposit transactions, first transaction will receive insurance coverage.

Benefit

Death Benefit

Subject to this Policy’s provisions, Manulife shall pay the Death Benefit in the event of the Life Insured’s (Member’s*) death upon receipt of acceptable proof and approval by Manulife of the Member’s death. The benefit proceeds will be paid to the beneficiary.

The Death Benefit proceeds shall be the amount specified on the Policy Information. A Member’s insurance under this Policy will be terminated upon the payment of benefit for that Member.

Total Disability Benefit

Total Disability is defined as the total and irrevocable:

  • Loss of sight of both eyes; or
  • Loss of use of two (2) limbs; or
  • Loss of sight of one (1) eye and total and irrevocable loss of use of one (1) limb.

"Loss of sight" means vision that even when tested with the use of visual aids, is measured at 3/60 or worse in both eyes using a Snellen eye chart or equivalent test.

"Loss of use" means total, continuous and permanent functional disablement of a limb, which has lasted for at least 180 days. This includes the physical loss of a limb; for arm, at the upper part of the wrist or for leg, at the upper part of the ankle.

Confirmation of Total Disability must be made by Manulife’s appointed registered medical practitioner/ physician/ doctor. The opinion of this registered medical practitioner/ physician/ doctor will be binding on the Life Insured and Manulife. For physical loss of limbs, this confirmation can be made at any time.

Subject to this Policy’s provisions, Manulife shall pay the Total Disability Benefit in the event of the Life Insured’s total disability upon receipt of acceptable proof and approval by Manulife of the total disability of the Member that meets the definition of Total Disability described above. The Total Disability Benefit proceeds will be paid to the Life Insured.

The Total Disability Benefit proceeds shall be the amount specified on the Policy Information. A Life Insured’s insurance under this Policy will terminate upon the payment of Total Disability Benefit for that Life Insured.


*The Member in the Policy means any person who is eligible, enrolled, and insured for insurance benefits provided for Members under the Policy. The term “Life insured” shall be deemed to include the term "Member."

Exclusion!

Death Benefit

The Life Insured’s death results directly or indirectly, in whole or in part, from any of the following:

  1. The member committed suicide or attempted suicide within two years from the date the Member’s insurance became effective, whether the Member is sane or insane; or
  2. The member’s death results directly or indirectly from a committed criminal offense or an attempted commitment of a criminal offense by the Policyowner, Member, or Beneficiary. Beneficiaries not involved in the aforementioned criminal activity will remain eligible to receive their benefits; or
  3. The member dies as a consequence of the Acquired Immune Deficiency Syndrome (AIDS) or any complications associated with infection by the Human Immunodeficiency Virus (HIV); or
  4. Member is currently part of the army, navy, air force, coast guard or any police organization; or
  5. Pre-existing conditions which originated Member’s effective date of insurance. A “Pre-existing Condition” is an illness or injury which the Life Insured has reasonable knowledge of, unless the conditions are declared to the Company and accepted by the Company. A Member may be considered to have reasonable knowledge of a pre-existing conditions where the condition is one for which:
    • The member had received or is receiving treatment;
    • Medical advice, diagnosis, care or treatment has been recommended;
    • Clear and distinct symptoms are or were evident;
    • Its existence would have been apparent to a reasonable person in the circumstances.

Total Disability Benefit

The Life Insured’s total disability results directly or indirectly, in whole or in part, from any of the following:

  1. Attempted suicide or any self-inflicted injury, whether sane or insane; or
  2. The member being under the influence of alcohol or the taking of any drug, except under the direction of a registered medical practitioner; or
  3. War or any act of war, whether declared or not, riot, insurrection, civil commotion, strikes, terrorist activities, whether or not the member was participating therein; or
  4. Commitment or attempted commitment of a criminal offense by the Policyowner, Member or Beneficiary. Beneficiaries not involved in the aforementioned criminal activity will remain eligible to receive their benefits; or
  5. Acquired immune Deficiency Syndrome (AIDS) or any complication associated with infection by the Human Immunodeficiency Virus (HIV); or
  6. Member is currently part of the army, navy, air force, coast guard or any police organization; or
  7. Pre-existing conditions which originated before the Member’s effective date of insurance. A “Pre-existing Condition” is an illness or injury which the Life Insured has reasonable knowledge of, unless the conditions are declared to the Company and accepted by the Company. A Member may be considered to have reasonable knowledge of a pre-existing conditions where the condition is one for which:
    • The member had received or is receiving treatment;
    • Medical advice, diagnosis, care or treatment has been recommended;
    • Clear and distinct symptoms are or were evident;
    • Its existence would have been apparent to a reasonable person in the circumstances.

 

Termination of a Life Insured's insurance

A Member’s insurance coverage provided under the Policy shall be terminated on the occurrence of the first of any of the following:

  • The Member having attained the age of fifty six (56);
  • Withdrawal or closure of Fixed Deposit;
  • Claim in respect of that Member has been paid;
  • Upon group policy termination;
  • Member enters the army, navy, air force, coast guard or any police organization;
  • Written notice from the Policyowner directing that the insurance be canceled.
